Accommodation and Booking Terms and Conditions
Terms and Conditions give everyone the safety of knowing what is expected of both parties. Here are the terms and conditions that apply to reservations at The Tower House in Kos.
Your contract is with Katerina Voudouris T/A The Tower House Kos (“we”, “us” and “our” in these Terms and Conditions) for the property known as The Tower House (“the Property”). References to “you” or “your” are references to the person making the booking and all members of the holiday party.
These Booking Conditions form the basis of your contract with us so please read them carefully. Nothing in these Booking Conditions affects your normal statutory rights.
- Making your booking
Your reservation is confirmed when we acknowledge receipt of your completed Booking Form and Initial Deposit. The Initial Deposit is only refundable if you cancel your booking within seven days of receiving our emailed confirmation of your booking. Your booking is made as a consumer for the purpose of a holiday. You acknowledge that no liability can be accepted for any business losses howsoever suffered or incurred by you.
We reserve the right to refuse any booking prior to the issue of our written/emailed confirmation. If we do this we will promptly refund any money you have paid to us. You should carefully check the details of our written/emailed confirmation and inform us immediately of any errors or omissions.
2. Paying for your booking
The final payment, as detailed on the booking form, must be with us on the due date specified. We may treat your booking as cancelled by you If payment is not received. The Damages Deposit is held for the reasonable cleaning and/or replacement of damaged or missing property, furnishings, fixtures and fittings. We will return the Damages Deposit to you within 14 days of the return of the keys to us or our agent, less any deductions in accordance with the conditions described above.
3. If you cancel or amend your booking
If you need to cancel or amend your booking, you must do so in writing or by email to the addresses shown on our confirmation. A cancellation will not take effect until we receive confirmation in writing or by email from you. If you cancel your booking earlier than four weeks before the date of arrival we will refund any money you have paid less the deposit. We cannot provide a refund if your booking is cancelled within four weeks of arrival.
If you wish to amend your dates, we will agree if the property is available for the new dates. The number in your party can be increased up to a maximum of 14 by giving us the details of the new guests.
4. If we cancel or amend your booking
Should circumstances arise which are outside our control we reserve the right to cancel your booking. We would then refund all that you have paid. Such circumstances include but are not limited by fire or earthquake at the Property, or war or civil unrest in Greece.
5. Your accommodation
You may arrive at The Tower House after 16:00 hours on the Arrival Date of your holiday. On your departure date we request you leave by 10:00 hours. These times may be able to be adjusted depending on your flight times and arrival and departure of other guests. Variations if any will be shown in our booking confirmation.
If your arrival will be delayed, you must contact us so that alternative arrangements can be made to welcome you at the Property. Failing to do so may mean you will not be able to gain access to the Property. If you do not arrive by midday on the day after the Arrival Date and you do not advise us of your late arrival we will treat the booking as having been cancelled by you.
When you arrive you will find the villa clean and fully equipped with the required number of beds made up. Towels will be provided, but must not be taken out of the property. Change of linen and towels is weekly. A charge is made for more frequent changes.
6. Your obligations
Guests must keep and leave the Property and the furnishings, kitchen equipment, crockery, glasses, cutlery, clean and in good condition.
You agree not to cause any damage to the walls, doors or windows of the Property. Respect of neighbouring properties is appreciated.
Guests must take all necessary steps to safeguard their personal property. No liability is accepted in respect of damage to, or loss of such property, except where the damage or loss is caused by our negligence.
Young children in your party must always be supervised to ensure their safety, particularly but not exclusively in and around the swimming pool, on balconies, staircases, terraces and in the steep parts of the grounds.
Each member of your party must be covered by comprehensive travel and health insurance. We recommend your policy includes cancellation, flight delays, loss and damage to baggage and other property. Evacuation and repatriation cover is also recommended.
You cannot allow people to stay in the Property other than those recorded on your booking form. Additional authorised guests can be added with any additional payment being made.
We do not allow pets in the Property. If you bring a pet, we can refuse to hand over the Property to you.
We will treat any of these circumstances as a cancellation of the booking by you.
You agree to allow us, or any representative of ours, access during your stay for the purpose of essential repairs.
7. Complaints
We make every effort to ensure that you have an enjoyable and memorable holiday. If however, you have any cause for complaint we will take remedial action as soon as possible.
You must contact us if a problem arises so that it can be speedily resolved. It is often difficult (and sometimes impossible) to resolve difficulties properly unless we are promptly notified. Telling us immediately will enable shortcomings to be rectified straight away. Complaints of a transient nature cannot be investigated unless registered whilst you are in residence. If any complaint cannot be resolved during your holiday, you must write to us within 28 days of your departure.
8. Our liability
Our liability for losses suffered as a result of us acting in breach of these terms and conditions is strictly limited to the rental paid. This does not include or limit in any way our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
9. Law
The contract between you and us is governed by the law of England and Wales. We both agree that any dispute which arises will be dealt with by the Courts of England and Wales.
Your agreement to these terms and conditions is confirmed by the return of a booking form and the payment of a deposit.
